Unless explicitly quoted and invoiced as such, Red Cactus will not be held liable for the content of your website.

Not only does this include the actual content but also adding it to your site. It remains the responsibility of the client to create and publish their own content.
As an exception, Red Cactus may quote the client to load the content of the site. This quote is based on supplied content or the standard hourly rate as determined by Red Cactus from time to time.

Website quotes, unless specifically agreed upon, do not include any copywriting or spell-checking, and it is the responsibility of the client to supply the content in the correct and final version before the site is built. Copywriting and proofreading services can be added at an additional cost.

Products (items in your store) are also considered content of the site. Red Cactus gladly provides a sample or template of a product on request, to assist the client in starting the process of loading their own products.

Where we did not explicitly quote to load the products, this remains the client’s responsibility.

Training for the loading and changing of content can be provided.

Unless a valid Maintenance agreement is in place, Red Cactus does not take any responsibility for the upkeep and maintenance (plugin updates, errors on the website, changes to the site and content, revisions, WordPress and Divi updates etc) of any website, once the site is signed off and goes live.

Red Cactus allows for a two (2) month waiting period for customer feedback. If no reasonable feedback has been provided, we commence with invoicing the work done as at that point in time.

REJECTION FEE
In the event of your cancellation of a project, or any delay of more than two months, after work has commenced, one of the following will be applicable:

• 20% cancellation fee
• An invoice for all work completed up to the date of written notification, including expenses; or
• The amount of any advance deposit made for your project.

All work will remain our property, but will be available if the project should be resumed at a later time.

In order to simplify the costing, unless otherwise stated, Red Cactus has a companywide standard rate.
Standard rates will be quoted in many areas of the website, and always refer to this standard rate.
Current standard rates @ R495.00 per hour.

All pricing provided on this site includes VAT.

Once we have developed your site, there are 2 ways to move forward:

1. As a self-managed service* you can install WordPress, create new database(s) and upload your theme and required plugins that will help with functionality of your website, therefore making it interactive for your visitors.
2. Alternatively, you can sign up for one of our maintenance contracts**, whereby we will manage all of the above for you, with your input, off course. This way we will ensure that all the plugins/add-ins are compatible with your installation and theme.

Please note the following:
*  Should you decide to make use of option 1 (self-managed service), you will be solely responsible for the updates and maintenance on your site.  Please visit our WordPress guide here 
Should anything go wrong with your site, we will gladly assist, although our standard support rate of R420.00/hour will take effect to investigate and possibly rectify any errors, seeing that we would not have been responsible for the development of the site.

**  You might feel that all of this is simply too time-consuming and rather decide to opt for one of our maintenance packages.  Kindly contact us to discuss the best package for your specific needs.

Important note:
The maintenance packages exclude the initial charge for development of the site and/or plugins purchased.

We will publish your site on your hosting space in a web staging area. This has the benefit that search engines (like Google) will scan and start to index your site from very early in the development phase, without being “live”.
The resources that this staging site consumes are the same as for a normal live production site. The client (You) is responsible for this hosting cost with your hosting provider. 

Although Red Cactus displays statistics of site visits using 3rd party tools we do not keep any statistics data for backup. As user you are responsible to manage the stats on your site. We give all web administrators access to the raw log files and encourage backup of these.

Red cactus agrees that the all the information disclosed by the client (you) including such information disclosed in writing, orally or by inspection of client’s (your) property, relating to (without limitation) the company’s prototypes, samples, technical data, trade secrets, know-how, actual and anticipated research, developments or products, product plans, services, software, inventions, processes, discoveries, formulas, architectures, concepts, ideas, designs, drawings, personnel, customers, markets, marketing plans, distribution methods, financial information, sales or programming matter, compositions, drawings, diagrams, computer programs, studies, work in process, visual demonstrations, manufacturing plans, confidential information disclosed to the company by third parties and other data, whether oral, written, evidence is now of subsequently becomes generally known or available by publication, commercial use or otherwise, through no fault of Red Cactus.

Red Cactus agrees to use the confidential information solely for the purpose to use all possible means to maintain the confidential information in strict confidence and at least those measures that it employs for the protection of its own confidential information, but in any event not less than a reasonable degree of care to disclose confidential information only to Red Cactus employees who are required to have the information to perform their duties on behalf of the client (you)
